Failure to understand these Terms says to me that you cannot read english and therefore - you are in violation. ~ Only one account per household. ~ Please be able to understand English. ~ Please be active. ~ Don't cheat. UPDATE TO TERMS ~~ OCTOBER 30, 2009 In order to request earnings earned from downlines, affiliate pages, and ptp, you will need 10% in personal earnings. Now to help offset this, I will include the usual of paid to clicks and paid emails, but I will also set it to include your CONTEST PTP WINNINGS. I chose to add this item in to help offset the 10% since this item is honestly earned and I feel that that is fair and we don't have points at the site. *free members: 15 links every 30 calendar days. *members with a Paid Upgrade: 25 link every 30 calendar days. *affiliate page/ptp members: 150 links every 30 calendar days. Since there are always over 300 ptc ads (not to mention emails), that means that you should spend under 15 minutes/once a month in order to keep your account active and within Terms. You will now only need 150 clicks in a calendar month in order to request payout. Effective July 1, 2009, Best Days will be blocking all Proxy IP's, College IP's, and all other "TYPES" of routers of that nature. If you are using one of these methods, your account will be deleted. Effective July 1, 2009, Best Days will no longer accept email addresses that continually bounce emails, including, but not limited to Yahoo.com, hotmail.com, and AOL.com. Gmail is a wonderful alternative if you need to know about one. Please be advised that as of June 1, 2009, in order to keep Best Days a profitable (sustainable) and enjoyable program, the "Warning System" has been put into place. What this means is that for certain "Terms" violations, you will receive a "Warning." Once your account has received three (3) "Warnings", your account will then be inelligible for payout. You will still be allowed to earn and enjoy all the perks of being a member, but you will need to use your site earnings for 'redemption only.' I wish to stay for a long time and I will not be taken advantage of. You will be sent a 'personal message' each time you receive a "warning." These basically are not negotiable since they are obvious Terms violations and you are given alot of lee-way, nor will I just 'remove' them from your account. Ways you can receive "Warnings": ~ More than 1 account per IP or household. ~ Complete gibberish and/or incomplete information on your profile page. ~ Failure to fix profile area within 30 days of being requested to by admin. ~ Failure to comply with requests from admin (or try to resolve the issue). ~ Not meeting activity requirements. ~ Clicking MORE THAN 3 cheat links in any 30 day period. ~ Clicking MORE THAN 10 bad turing numbers in any 30 day period. ~ Any visit to a bot trap page. ~ Continual submit (more than 3) of a 'banned site' for advertising. ~ 3 failed English Tests within a 30 day period. ~ Marking "Search" in your profile when you are not from a "search friendly country". ~ Bad Keyword Selections. Activity Requirements: 50 links every 30 days to remain active. 100 links every 30 days to use and maintain your free upgrade. 200 links every 30 days to use and maintain your affiliate page/ptp priveledges. (Failure to maintain this will result in your page or PTP priviledges being suspended for 30 days without warning and PTP/Affiliate earnings for that month cleared.) 45 day inactive accounts will be deleted. 300 links before you can request payout. **Lifetime constitutes the "lifetime" of your active membership. Members will be informed of any and all changes to this policy via email and/or administrative message sent viaBest-Days.com. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the Best-Days.com program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change. Responsibility of Affiliates: You must be 18 years of age or older to participate in this program. Our program is open to both US and International English understanding/reading affiliates and is void where prohibited by local governing laws. As of March 1st, all yahoo, hotmail and AOL email addresses will no longer be allowed. There are too many emails bouncing back. You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You must also sign up with all correct address information as well. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual that has an existing Best-Days.com account. If multiple accounts are found all accounts will be DELETED and all earnings and downlines will be lost. You will not be reinstated!! You will use your email address / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link. You are solely responsible for any and all use of your Best-Days.com account including authorization by you to any third party individual who may use your account. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by Best-Days.com be detected it may result in member termination and possible legal action. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. You must maintain your email account that you used when signing up Best-Days.com. You must maintain your e-mail account that you used when signing up with Best-Days.com. You agree to receive e-mail advertising from Best-Days.com. You must maintain your email account that you used when signing up Best-Days.com. You must maintain login to your account once every 20 days and click at least 75 links if you have a free upgrade or have an affiliate page. Accounts will be reviewed betweem the 26th through the 29th of each month at which time if the requirements are not met your account will be SUSPENDED. All accounts will then be reviewed on the last day of the month for review of clicking the minimum clicks (75) if it has not been reached (and you have not contacted me to unsuspend your account) your account will then be deleted. Accounts may be reinstated one time only at the admin's discretion. Please note a free member who does not have an affiliate page or have a free upgrade has no monthly click requirements. In the event your e-mail account on file becomes closed or blocked to messages from Best-Days.com, your account will be terminated. This especially applies to e-mail accounts returned for being Full. Any member sending us gibberish will result in automatic termination of account and Forfeiture of All earnings to date of termination. Auto-responses will also be deleted immediately. No one may sell or transfer an account to any other member without permission of the owner. Both account will be deleted and all downlines or earnings lost. Best-days.com is not responsible for any agreements made with any outside parties. You may not sell, trade members, points or earning without permission of Best-days.com Relationship of the Parties: You and Best-Days.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and Best-Days.com. You understand that you do not have authority to make or accept any offers or make any representations on behalf of Best-Days.com. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program. This is a paid to read program. You must be reading mail ads and not just clicking ptc banners. Those only doing ptc's will be deleted and earnings lost. From time to time cheat links/banners and or reading tests will be sent. These are clearly marked as such. Three or more clicks on these tests will result in your account being terminated! NO EXCEPTIONS! If a link is sent for the wrong amount, it will be rolled back and earnings or points removed from the accounts of those who clicked those wrong links. Limitation of Liability: Best-Days.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or Best-Days.com program, even if Best-Days.com has been advised of the possibility of such damages. Furthermore, Best-Days.com aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. Members must be 25% as active as the members on your downline. Examples: same IP address, same Payment Account or same computer ID. 4) Having incorrect info listed in user's account, all information must be filled in completely. 5) Have bad interests selected in their accounts such as cheater, I cheat, or selecting search when not from a search friendly country 6) Being disrespectful or threatening to the admin 7)Any members sending gibberish or unreadable/non English mails will be deleted. 8)Anyone found trashing, bashing or threatening the admin in any public forum will be deleted. This does not mean you can not engage in meaningful posting about the site. 9)No one may repost and or reprint any admin message or any part of a communication from this site for any reason. Responsibility of other Webmasters/Program Owners: Effective June 1, 2009 - If you require 10% (or more) in personal earnings vs. ptp/affiliate page earnings at your sites, this will apply here. You will hold yourself to the same acceptable standards that you hold your own members to. If you require 1 email every 15 days at your site to remain active, then that applies here also. If you have a $3 maximum per request per 30 days at your site, then that applies here also. I didn't want to do this but there are too many sites out there that require 10% (or more) in personal earnings (which I do NOT mind, I understand the need for it due to the abusers) but what I don't understand is how you can have only 43 ptc's for your members to click on (and this is their Terms and they chose to not have the ads available for members to click on). Administration Messages: Admin messages sent to the members are solely intended for the members of this site only. If you are found to be copying these Admin Messages in any other forum such as GPF, Been Paid or any other forum without the consent of the program owner, your account will be deleted and all earnings and downlines will be forfeited. We wish you to resolve your complaint with the PO of this site FIRST - but pasting of Admin messages sent to our Members, at any forum of any type is strickly prohibited and will not be tolerated... You WILL be terminated immediately !! Spam: You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your affiliateship with Best-Days.com and may result in legal prosecution. Best-Days.com strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. Best-Days.com may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. Best-Days.com will file charges for recovery of any earnings received from multiple sign-ups.
